Please scroll almost to the bottom of the page on this URL: http://www.indiainbusiness.nic.in/visitors-guide/visa.htm. There are two paragraphs for PIO card holders as given below:
PIO (Persons of Indian Origin) Card holders : Following the introduction of the PIO Card scheme, PIO card holders are eligible for visa free entry into India for a period of the validity of the card i.e. 15 years, and they are NOT required to register themselves with the concerned FRO/FRRO if their continuous stay does not exceed 180 days. If the continuous stay exceed 180 days, the foreigner should approach the concerned FRO/FRRO for registration within 30 days of the expiry of 180 days, who will in turn register them.
Children below 16 years: As per para 2 of Registration of Foreigners (Exemption) Order, 1957, children below the age of 16 years are exempt from the requirement of registration.
So, it seems, kids don't need to register. Common sense does prevail even in India sometimes. :D

Fastest way to move to H4 is goto India and get your H4 stamped or file I539 for COS to H4. If you apply for COS to H4, you application will be in pending state considering all the backlogs as VSC/CSC. You can move to H1 whenever you wish and you will not be counted against quota, provided you have not exceeded the 6 year limit.

Considering the state of the economy and considering that the most important poisiton to save is that of the primary applicant, I suggest that USCIS process cases of primary applicants asap.
Family members can contnue on EAD for long time; however if the principal applicant loses job and can not find another one, the entire family is done - pack bags and leave.
What do you think?
ssh --> I see from your profile your PD as 2001 and understand your frustration, waiting long. I like the idea what you has told... but not sure if it is practical.
Even I think, we need to ensure, the criteria for apply for EB immigration must be met @ the time the application is accepted. But after that, if the applicant status change in the interim, that should not jeopardize the entire applicaiton it self. With EB, they want to ensure, the status is met @ the time of approval, but given the present economic condition, any thing can happen, and hope USCIS, does not utilize this to penalize the law abiding legal immigrant folks for the delay by USCIS in processing application.
I'm not sure, The application eligibility should be verified/met at the time an application is accepted for processing and not @ approval is my view. But might not be acceptable to vast majority. Return the application immediately if criteria is not met, but not after many many years.

As Fromnaija correctly explained, if you are an applicant for AOS with an approved EAD you are authorized to remain legally in the US as long as your application is pending. You Whether or not you are working does not matter.

In order to be eligible for EB-2 classification you must have the equivalent of a US Master's Degree AND a US Master's Degree or its equivalent must be the minimum requirement for the position that is the subject of the I-140 Immigrant Visa Petition.
In other words, even if your education equates to a US Master's degree, you will not qualify for EB2 classification unless the empolyer can show that the job duties of the position could not be successfully performed by anyone not possessing at least a Master's degree or its equivalent.

I have a H1B from my previous employer and my H1B Visa (not I-94) is valid untill 6th September 2011,However I moved on to a different employer in August 2010 and through them i filed a H1B Transfer and Extension (application was approved in January 2011).
However i have to make a emergency visit to India (New Delhi) this month, so do i need to re-stamp my visa again for the new employer or can i re-enter US based on my old h1 visa and at the Port of Entry show my new H1 docs.
Is that a valid thing to do or do i need to re-stamp my visa.

All the cases filed in feb 2007 and sent to nebraska are still pending including mine. Some cases filed in feb in texas center have been processed.
Don't worry you need to wait atleast few more months for them to start looking at your application.

You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.

um...looks gritty? u talking about the 'rays', rite? i made it by drawing the lines and then radial blurring it...i used the good quality, maybe i should use the best quality next time :)
i have made some changes, including removing the words in the upperleft..but i can't change the flare cos i don't want to do it again :smirk: (took quite awhile ;))

2. New/Extend H-1B for 3 year, but will be subject to cap
3. can get new/extension H-1B for 3 years without cap, if you have I-140 approved
4. can get new/extension H-1B for 1 year without cap, if I-140 is pending

The reason I was asking is because recently this application to consider this as a new H1b for 3 years was rejected and instead only one year (recapture time for year abroad) was issued.
