URGENT HELP
Its a simple case. I read all the posts on this thread but I dont think I got an answer I want. Here is my dilemma -
Scenario: I currently work for Company A. I interviewed with Company B and they are ready to file for my H1b transfer but they need me to join within the next 3 weeks. Today is Feb 6th 2008.
Question1) Is there anything like a H1Btransfer or is it a brand new application??
Question2) Does this H1B transfer go through the 65,000 quota system?? Is there a chance my H1B transfer can be rejected because I did not make it in the 65,000?
Question3) When can I start working for Company B?
Question4) Company B said that I should only inform Company A after I get a receipt from USCIS about my H1B transfer. If Company A matches up the salary what Company B is offering me after I inform them and I still havent started working with Company B, can I stay with Company A? If yes, What about the H1B transfer application by Company B?

All ,
I am working for company "x" and having middle vendor "y"
and middle vendor has got me job and , working in the client location "z" of the middle vendor
I have signed non-compete agreement with middle vendor , that i should not join with client "z" (introduce by middle vendor) for 2 years after my termination.
The vendor "y" is not willing to work with my client "z"
and vendor "y" is saying to me i should not work with "z" because i have signed non-compete agreement.
Is it legal for my vendor "y" to say that i should not work with "z"
if they don't want to do business with "z"

I would suggest you ask your employer B to file thru premium processing. Just to be on the safe side
cancellation takes atleast a month if not more. (4-5 months is not a confirmed number so its better to assume the worse case of 1 month)

I am working for a consulting firm and my 6 year H1 is expiring on March 2012. My I-140 is approved as of Dec 2008(EB3) - pd Aug 2007. I-485 not filed yet due to PD not current.
I have a fulltime offer from my client which is a global bank and so i would like to move to them
My question is I don't have I-140 approval notice, but have the receipt notice and also can print out the status on the USCIS website. Also I have my Alien #
My current employer wont give the copy of approval.
1. With this Can I apply for I-140 based 3-year transfer?
2. Also, once I get 3 years approved and join the new employer, if the old employer revokes I-140 will I be in trouble?
have not filed 485 there is no use for you of approved 140 except you can use the PD. You will have to start GC processing again with new employer.(PERM-140-485).
You should get a 3 year ext based on old employers 140.

What I mentioned above applies to new H1 filing. The person can start working as soon as H1 is approved which can be as quickly as 15 days or less if done under Premium Processing.
People who have been counted against the quota in the last 6 years are exempt from it and can apply for new H1 with different employer without being subjected to the quota again.

It's a bit dark and I feel like it dead-ends at the doorway. I probably would've either walked forward a bit to get some of the road that looks like it's headed uphill (which would draw the eye in that direction) or I would've moved a little to the left to get a bit more of the road into the shot and show the hanging plant a little better. Moving a bit to the left might also have brought a little more light into the shot.

I could take upto 3 months of sabbatical partially paid (1st month:100%, 2nd,3rd-50%) - I am currently on H1 Visa and working for the employer who sponsered by GC. I would like to know if there is any effect of taking sabbatical on my pending I485 ?

I have a valid H1-B visa till November 2011from Company A. I joined Company B in July 2009. I have got my Company B approval notice I-797 from USICS.
Due to my fathers health I'm travelling to Pakistan in October for a one week vacation. I have my approval notice from Company B and the visa transfer is done. My new approval notice is till June 2012.
My question is do I have to go for stamping when I go to Pakistan because I changed companies even though I have a valid visa from my previous company and an approval notice from my current company?
I will highly appreciate your Quick help in this regards.

You can travel using A's stamped visa, you do not have to go for stamping. Show your A's visa stamp and B's approved 797 at POE when you return. POE officer will issue I-94 validity up to B's 797 expiry date. Also, carry recent paystubs and employment verification letter to be safer.
